1. Acceptance of Terms

By downloading, installing, or using the TAPD application ("App") or any related services provided by Lifeline Labs LLC ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

TAPD is a mobile application that allows users to store personal emergency profile information on NFC-enabled tags. This information may include medical details, emergency contacts, and other personal data intended to assist first responders in emergency situations. The App enables users to write data to NFC chips and generate a scannable emergency profile accessible by third parties such as emergency personnel.

3. Eligibility

You must be at least 18 years of age to create an account and use the App. If you are creating a profile on behalf of a minor or a pet, you represent that you are the legal guardian or owner and have the authority to submit that information.

4. User Accounts and Profiles

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when creating profiles. Lifeline Labs LLC is not responsible for any harm resulting from inaccurate, incomplete, or outdated information stored in your emergency profiles.

5. NFC Tags and Hardware

TAPD is designed to work with NFC-enabled tags and devices. We do not guarantee compatibility with all NFC hardware, Android devices, iPhones, or third-party readers. The performance of NFC tags is subject to environmental conditions, physical damage, device compatibility, and other factors outside our control. Lifeline Labs LLC is not responsible for NFC tags that fail to write, read, or transmit data correctly.

You are solely responsible for ensuring that your NFC tag is properly programmed, physically accessible, and readable in an emergency situation.

6. User Responsibility for NFC Tags and Profile Access

By programming and deploying an NFC tag using TAPD, you acknowledge and accept full responsibility for:

  • Tag placement and accessibility. You are responsible for where you place your NFC tag, how it is mounted or worn, and whether it is physically accessible to others in an emergency.

  • Who can scan your tag. NFC tags programmed with TAPD can be scanned by any NFC-capable device within physical proximity. This includes not only first responders, but also members of the general public, bystanders, or any other individual who comes into contact with your tag. Lifeline Labs LLC has no ability to restrict or control who scans your tag once it is deployed.

  • Information visibility. Any information stored on your NFC tag or linked profile may be read by anyone who scans it. You are solely responsible for deciding what personal, medical, or contact information you choose to include. Do not include information you are not comfortable being accessible to any person who may scan your tag.

  • Tag condition and accuracy. You are responsible for maintaining your tag in good physical condition, ensuring it is not damaged or demagnetized, and keeping the profile information it points to current and accurate.

  • Unauthorized or unintended scans. Lifeline Labs LLC is not liable for any consequence arising from your tag being scanned by an unintended party, including but not limited to privacy concerns, misuse of profile information, or unauthorized access to any linked content.

You accept these conditions knowingly and voluntarily as a prerequisite to using TAPD's NFC writing features.

7. Emergency Use Disclaimer

TAPD is not a substitute for professional emergency services. The App is designed as a supplementary tool to assist first responders, not as a guaranteed method of emergency communication or medical identification.

Lifeline Labs LLC makes no representations or warranties that:

  • First responders will scan or read your NFC tag in an emergency

  • Any device used by a first responder will be compatible with your NFC tag

  • The information on your tag will be accessed, read, or acted upon in time

  • The App or NFC tag will function in all emergency scenarios

In any emergency, always call 911 or your local emergency services number.

8. Medical and Personal Information

You choose what information to store in your emergency profile. Lifeline Labs LLC does not verify the accuracy of any medical information, emergency contacts, or other personal data you enter. You are solely responsible for keeping your profile information accurate and up to date. Outdated or incorrect medical information could have serious consequences; we strongly encourage you to review and update your profile regularly.

9. Privacy and Data Use

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

Key points:

  • Emergency profile data you store may be made accessible to anyone who scans your NFC tag, including first responders and members of the public.

  • You are responsible for deciding what information to include in publicly readable profiles.

  • We do not sell your personal information to third parties.

10. Pet Profiles

The App supports emergency profiles for pets. By creating a pet profile, you represent that you are the lawful owner of the pet and that the information you provide is accurate. All disclaimers regarding data accuracy and NFC performance apply equally to pet profiles.

11. Prohibited Use

You agree not to use the App to:

  • Store false, misleading, or fraudulent information

  • Impersonate another person or misrepresent your identity

  • Interfere with the operation of the App or its infrastructure

  • Use the App for any unlawful purpose

  • Attempt to reverse engineer, hack, or exploit the App or its systems

12. Intellectual Property

All content, branding, logos, and software associated with TAPD and Lifeline Labs LLC are the intellectual property of Lifeline Labs LLC. You may not copy, reproduce, distribute, or create derivative works from any part of the App or its content without our prior written consent.

13. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Lifeline Labs LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of life, personal injury, property damage, or loss of data, arising out of or related to your use of the App or any NFC tag programmed with it — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Lifeline Labs LLC and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, your deployment of any NFC tag programmed using the App, or your infringement of any third-party rights.

16. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, and you consent to personal jurisdiction in those courts.
